TERMS OF SERVICE

1. Scope

The following terms and conditions apply to all orders via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

These terms and conditions also apply to future business relationships with entrepreneurs, without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to this.

2. Contractual partner, conclusion of contract

The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding online catalogue. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the steps provided for this purpose in the ordering process and use the explained correction aids. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The receipt of your order will be confirmed by e-mail immediately after the order has been sent.

When the contract is concluded with us depends on the payment method you have chosen:

Payment in advance
We accept your order by sending a declaration of acceptance in a separate email within two days, in which we give you our bank details.

Credit card
When you place your order, you send us your credit card details at the same time. After your legitimation as the legitimate cardholder, we will request your credit card company to initiate the payment transaction and thereby accept your offer.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment order to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

Amazon Pay
In the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. There you can select the delivery address and payment method stored at Amazon and confirm the payment order to Amazon. You will then be redirected to our online shop, where you can complete the ordering process. After placing the order, we ask Amazon to initiate the payment transaction and thereby accept your offer.

Apple Pay
During the ordering process you will be redirected to the website of the online provider Apple. There you can enter your payment details and confirm the payment order to Apple. After placing the order in the shop, we ask Apple to initiate the payment transaction and thereby accept your offer.

Google Pay
During the ordering process, you will be redirected to the website of the online provider Google. There you can enter your payment details and confirm the payment order to Google. After placing the order in the shop, we ask Google to initiate the payment transaction and thereby accept your offer.

Amazon Pay
In the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to be able to complete the ordering process and pay the invoice amount via Amazon, you must be registered there or first register and authenticate yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected to our online shop, where you can complete the ordering process.

Apple Pay
In order to be able to pay the invoice amount via Apple Pay, you must use the "Safari" browser with which the service provider Apple is registered, have activated the Apple Pay function, identify yourself with your access data and confirm the payment order. The payment transaction is carried out immediately after placing the order. You'll get more information during the ordering process.

Google Pay
In order to be able to pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, identify yourself with your access data and confirm the payment order. The payment transaction is carried out immediately after placing the order. You'll get more information during the ordering process.

6. Retention of Title

The goods remain our property until full payment.

7. Damage in transit

The following applies to consumers:
If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

8. Warranty Rights

Statutory warranty rights apply to all goods from our shop. If the goods delivered by us are defective, you can, within the framework of the statutory provisions, either request the removal of the defect or the delivery of goods free of defects (subsequent performance). If the supplementary performance fails, you can reduce the purchase price or withdraw from the contract in the case of a significant defect. If subsequent performance is not possible for us, you are entitled to withdraw from the contract and to request a refund of the purchase price

9. Liability

We and our legal representatives and vicarious agents are only liable for damage other than damage to life, limb and health if these damages are based on intentional or grossly negligent action or on culpable violation of a material contractual obligation by us or our vicarious agents. An obligation is essential to the contract, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which you can regularly rely. Any further liability for damages is excluded. Claims from a guarantee given by us for the quality of the goods and from the Product Liability Act remain unaffected. In the event of a breach of essential contractual obligations, Flaconi is only liable for the contractually typical, foreseeable damage if this was caused by negligence, unless it is a matter of claims for damages resulting from injury to life, limb or health.

According to the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. We are therefore not liable for the availability of the offer at www.djeo.de at all times

11. Offsetting / right of retention

You only have the right to offset if your counterclaims have been legally established or recognized by Djeo. In addition, you are only authorized to exercise a right of retention insofar as your counterclaim is based on the same contractual relationship.

12. Governing Law

The legal relationship between you and Djeo is subject to the law of the Federal Republic of Germany. The provisions of the Vienna UN Sales Convention do not apply. The same applies to any other international agreements, even after their adoption into German law. In the case of contracts with consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
